These Terms of Service ("Terms") govern your access to and use of The 4UNT mobile application, website, services, and related features (collectively, the "Platform"), operated by The 4UNT and its owner/operators (the "Company," "The 4UNT," "we," "our," or "us").

The Platform is currently operated as an independent project and may later be transferred to a formally organized legal entity, including but not limited to The 4UNT LLC or another successor entity. Upon such formation, these Terms shall automatically apply to and be administered by that entity without requiring additional user consent.

By creating an account, accessing, or using The 4UNT, you agree to these Terms.

If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 13 years old to use The 4UNT Platform.

By creating an account or using the Platform, you represent and warrant that:

  • You are at least 13 years of age

  • You have the legal capacity to agree to these Terms

  • You will comply with all applicable laws and regulations

Users between the ages of 13 and 17 may only use the Platform with the permission and supervision of a parent or legal guardian. By allowing a minor to use the Platform, the parent or guardian agrees to these Terms on the minor’s behalf and accepts responsibility for the minor’s use of the Platform.

The 4UNT does not knowingly collect personal information from children under 13 in accordance with the Children's Online Privacy Protection Act (COPPA). If we become aware that an account has been created by a user under 13, we reserve the right to suspend or delete the account.

The 4UNT relies on user-provided information and is not responsible for verifying user age.

2. Nature of The Platform

The 4UNT is a voluntary participation platform that provides creative challenges, community activities, and scoring systems designed to encourage exploration, creativity, and engagement (collectively, the "Challenges").

The Platform may:

  • Suggest optional activities

  • Provide challenge descriptions

  • Provide scoring systems

  • Host user submissions

  • Facilitate community participation

  • Highlight sponsor or location-based activities

The 4UNT provides a platform only. The 4UNT does not direct, control, or require how any Challenge is completed. Users independently decide how, when, where, and whether to participate.

The Platform DOES NOT:

  • Direct user behavior

  • Supervise users

  • Monitor user safety

  • Provide emergency services

  • Provide security services

  • Require participation in any Challenge

  • Control how Challenges are completed

  • Guarantee safe conditions

The 4UNT is not responsible for user decisions, actions, or outcomes resulting from participation.

All participation is voluntary and undertaken at the user’s own discretion.

3. Voluntary Participation

All Challenges are optional.

You decide:

  • Whether to participate

  • Which Challenges to attempt

  • How to complete them

  • When to stop

You may stop or abandon any Challenge at any time, for any reason, without penalty beyond the loss of potential points or rewards associated with that Challenge.

Participation is entirely voluntary and self-directed. You are never required to attempt or complete any Challenge.

If a situation feels unsafe:

STOP IMMEDIATELY.

Your safety always comes first.

The 4UNT does not expect or require users to continue any activity once started.

4. Assumption of Risk

By participating in The 4UNT, you acknowledge that participation in Challenges and related activities may involve inherent risks, including both known and unknown risks, which may result in injury, illness, property damage, or other harm.

These risks may include, but are not limited to:

  • Travel risks

  • Environmental exposure

  • Physical activity

  • Interaction with public spaces

  • Interaction with other participants or members of the public

  • Transportation risks

  • Weather conditions

  • Conditions at third-party locations

  • Accidental injury

  • Unforeseen hazards

You understand that The 4UNT does not control the conditions under which Challenges are completed and does not guarantee safety.

By choosing to participate, you voluntarily assume all risks associated with participation, whether foreseeable or unforeseeable.

You agree that participation is entirely voluntary and undertaken at your own discretion and risk.

You further acknowledge that you are solely responsible for evaluating whether a Challenge is appropriate for your abilities, experience, location, and circumstances.

5. Personal Responsibility

You agree that you are solely responsible for your participation in The 4UNT and any activities related to Challenges.

You are solely responsible for:

  • Your decisions

  • Your safety

  • Your conduct

  • Your travel and transportation choices

  • Your physical and mental condition

  • Your use of equipment or props

  • Your awareness of surroundings

  • Your interactions with other individuals

  • Your compliance with all applicable laws and rules

You are responsible for determining whether you are physically and otherwise capable of participating in any Challenge.

The 4UNT is not responsible for how you choose to complete a Challenge or for the choices you make while participating.

The 4UNT does not supervise, monitor, or control user participation and is not responsible for user judgment or actions.

6. Legal Compliance

You agree to comply with all applicable laws and regulations while using The 4UNT and participating in any Challenge.

You agree to:

  • Follow all local, state, and federal laws

  • Follow property rules

  • Follow business policies

  • Follow transportation laws

  • Follow safety regulations

  • Follow posted rules at any location

You may not:

  • Trespass

  • Damage property

  • Harass others

  • Violate any law

  • Enter restricted areas

  • Disrupt businesses

  • Endanger yourself

  • Endanger others

You are solely responsible for determining whether your actions comply with applicable laws and rules.

The 4UNT does not require or encourage illegal activity. If a Challenge could be interpreted to require illegal behavior, you must choose a legal alternative method of completion or not participate.

If a Challenge would require illegal activity:

DO NOT DO IT.

Failure to comply with laws or these rules may result in:

  • Removal of submissions

  • Loss of points

  • Account suspension

  • Account termination

7. Business & Public Space Conduct

When interacting with businesses, organizations, or public spaces while participating in The 4UNT, you must:

  • Be respectful

  • Follow all posted rules

  • Follow all staff instructions

  • Not disrupt normal operations

  • Not interfere with customers or employees

  • Not demand participation

  • Leave immediately if asked

  • Follow all public use guidelines

Participation in The 4UNT does not grant any special privileges or access rights. Businesses and property owners are not required to participate and may refuse interaction at their discretion.

Users may not:

  • Pressure businesses or employees to participate

  • Misrepresent themselves as representatives of The 4UNT

  • Claim official authority

  • Create disturbances

  • Damage relationships between The 4UNT and community partners

The 4UNT is not responsible for how businesses, organizations, or property owners respond to users.

Failure to follow these rules may result in removal from the Platform.

8. Filming & Consent

You are responsible for ensuring that any photos, videos, or recordings submitted to The 4UNT comply with all applicable privacy, publicity, and recording laws.

You must obtain consent before:

  • Filming identifiable individuals

  • Recording on private property

  • Recording inside businesses

  • Recording where permission is required

  • Recording minors without permission from a parent or guardian

You are solely responsible for obtaining any necessary permissions or releases from individuals appearing in your submissions.

You may not submit content that:

  • Violates privacy rights

  • Violates publicity rights

  • Was recorded without required consent

  • Harasses or exploits individuals

  • Violates applicable recording laws

Participation in The 4UNT does not grant permission to film any person or property.

The 4UNT is not responsible for disputes related to recording or submitted content.

We reserve the right to remove any submission that raises privacy concerns.

9. Transportation Risks

You are solely responsible for all transportation decisions made while participating in The 4UNT.

You are solely responsible for:

  • Driving decisions

  • Travel safety

  • Route choices

  • Transportation risks

  • Obeying traffic laws

  • Paying attention to surroundings

  • Avoiding distracted driving or travel

The 4UNT does not require any specific method of transportation and does not encourage unsafe travel behavior.

You agree that you will not use The 4UNT in a manner that distracts you while driving, biking, or operating any vehicle.

You are responsible for safely stopping your vehicle before interacting with the Platform.

The 4UNT is not responsible for accidents, injuries, or incidents that occur during travel related to participation.

10. Account Registration

To use certain features of The 4UNT, users must create an account and provide required information, which may include:

  • Full name (for internal use)

  • Username (public identity)

  • Email address

  • Other required account information

Usernames may be displayed publicly and must not:

  • Impersonate others

  • Use offensive or harmful language

  • Misrepresent affiliation with The 4UNT

  • Violate intellectual property rights

The 4UNT reserves the right to require username changes if necessary.

You agree to provide accurate information to the best of your ability. The 4UNT is not responsible for verifying the accuracy of user-provided information.

You are responsible for:

  • Maintaining the confidentiality of your account

  • Protecting your login credentials

  • All activity occurring under your account

You agree to notify The 4UNT if you believe your account has been compromised.

The 4UNT is not responsible for losses resulting from unauthorized use of your account.

11. Account Termination

The 4UNT reserves the right, at its sole discretion, to suspend, restrict, or terminate accounts, remove content, or limit participation for any reason, including but not limited to:

  • Violations of these Terms or Participation Rules

  • Unsafe behavior

  • Harassment or abuse

  • Illegal activity

  • Cheating or fraudulent submissions

  • Misconduct

  • Behavior that harms the community

  • Behavior that damages The 4UNT’s reputation or relationships

  • Attempts to exploit or manipulate the Platform

Termination or suspension may occur with or without notice.

The 4UNT also reserves the right to:

  • Remove submissions

  • Adjust scores

  • Revoke points

  • Disqualify users from Challenges

  • Restrict access to features

Users whose accounts are terminated may lose access to:

  • Submissions

  • Points

  • Ranking

  • Prizes

  • Membership benefits

The 4UNT is not required to provide warnings prior to enforcement actions.

12. User Conduct Rules

Users must conduct themselves in a respectful and lawful manner while using The 4UNT.

Users may not:

  • Harass, bully, or intimidate others

  • Discriminate based on race, ethnicity, gender, religion, disability, sexual orientation, or other protected characteristics

  • Threaten violence or promote violence

  • Submit hateful, abusive, or offensive content

  • Engage in dangerous or reckless behavior

  • Submit fraudulent or misleading content

  • Impersonate other users or organizations

  • Misrepresent affiliation with The 4UNT

  • Attempt to exploit or manipulate the Platform

  • Interfere with other users’ participation

  • Encourage unsafe or illegal activity

Users must not use the Platform in a manner that harms:

  • Other participants

  • Businesses

  • Community partners

  • The reputation of The 4UNT

We reserve the right to:

  • Remove content

  • Remove submissions

  • Remove users

  • Restrict access

  • Take enforcement action

At our sole discretion.

13. Challenges & Scoring

Each Challenge may include:

  • Base points

  • Bonus points

  • Creative scoring

  • Time-based scoring

  • Sponsor-based scoring (where applicable)

Scoring may include both objective and subjective evaluation criteria.

The 4UNT has final authority over:

  • Challenge interpretation

  • Whether a submission meets challenge requirements

  • Whether a submission meets the intent of the Challenge

  • Valid submissions

  • Point awards

  • Bonus points

  • Disqualifications

  • Score adjustments

  • Tie determination

The 4UNT reserves the right to adjust scores to correct errors, prevent abuse, or maintain fair play.

All scoring decisions are final.

The 4UNT is not required to provide scoring explanations or review requests.

Participation does not guarantee points, rankings, or rewards.

14. Challenge Modifications

The 4UNT reserves the right, at its sole discretion, to:

  • Add challenges

  • Remove challenges

  • Modify challenge rules

  • Change scoring methods

  • Adjust deadlines

  • Cancel challenges

  • Replace challenges

  • Modify challenge availability

These changes may occur at any time and for any reason, including safety concerns, technical issues, fairness concerns, or operational needs.

The 4UNT does not guarantee the availability of any Challenge, point value, or reward opportunity.

Participation in a Challenge does not guarantee completion eligibility, scoring, or reward eligibility.

The 4UNT reserves the right to modify Challenges to maintain safety, fairness, and platform integrity.

15. Cheating

Cheating includes, but is not limited to:

  • Fake submissions

  • Misrepresentation

  • Submitting content you did not create or do not have rights to

  • Stock media misuse

  • AI misuse (unless allowed by the Challenge)

  • Rule circumvention

  • Exploiting technical loopholes

  • Purchased submissions

  • Fraudulent check-ins

  • Manipulating location verification

  • Attempting to bypass challenge intent

The 4UNT reserves the right to determine what constitutes cheating or abuse of the Platform.

Attempts to exploit technicalities that bypass the intended purpose of a Challenge may be treated as cheating.

The 4UNT may investigate suspicious activity and take enforcement action including:

  • Removal of submissions

  • Removal of points

  • Score adjustments

  • Disqualification from Challenges

  • Account suspension

  • Account termination

Enforcement actions may occur retroactively if cheating is discovered after points have been awarded.

All determinations regarding cheating are final.

16. AI Use

AI tools may only be used when:

  • Allowed by the specific Challenge
    OR

  • Not prohibited by the Challenge instructions

If a Challenge requires original human participation, creativity, or physical activity, AI-generated submissions that bypass the intended purpose of the Challenge may be disqualified.

Use of AI to misrepresent participation, fabricate activity, or bypass Challenge intent may be treated as cheating.

The 4UNT reserves the right to determine whether AI use violates the spirit or requirements of a Challenge.

Failure to comply may result in:

  • Removal of submissions

  • Removal of points

  • Disqualification

  • Account enforcement actions

17. User Content Ownership

You retain ownership of content you submit to The 4UNT ("User Content").

By uploading or submitting content, you grant The 4UNT a non-exclusive, worldwide, royalty-free license to:

  • Use

  • Display

  • Share

  • Reproduce

  • Modify

  • Adapt

  • Publish

  • Distribute

  • Promote

Your User Content in connection with the Platform, its operation, promotion, marketing, and related activities.

This license allows The 4UNT to:

  • Display submissions within the Platform

  • Feature submissions in marketing materials

  • Share submissions on social media

  • Include submissions in promotional content

  • Share submissions related to sponsor Challenges where disclosed

You understand that you will not receive compensation for such use.

You represent that you have the necessary rights to submit any content you upload.

18. Content License

By submitting content to The 4UNT, you grant The 4UNT a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual license to use your submitted content for:

  • Platform use

  • Marketing

  • Promotion

  • Social media

  • Sponsor promotion (where disclosed)

  • Community features

  • Platform improvement

This license includes the right to:

  • Display content

  • Reproduce content

  • Modify content for formatting or presentation

  • Adapt content for promotional purposes

  • Distribute content

  • Archive content

This license continues even if your account is deactivated, except where content removal is required by law.

You understand and agree that:

  • You receive no compensation

  • The 4UNT is not required to use your content

  • Previously used marketing materials may continue to exist after content removal requests

  • The 4UNT may allow partners or sponsors to view submissions related to their Challenges

19. Sponsor Challenges

Sponsor Challenges may include:

  • Brand-related activities

  • Prize offerings

  • Location-based activities

  • Promotional opportunities

Sponsors may provide prizes, locations, or promotional opportunities associated with specific Challenges.

Sponsors:

  • Do not control gameplay

  • Do not determine scoring

  • Are not responsible for user participation

  • Are not liable for user actions

  • Are not liable for Challenge outcomes

Participation in Sponsor Challenges does not create any relationship between users and sponsors, including employment, agency, or partnership.

Users interact with sponsor locations and businesses at their own discretion and risk.

The 4UNT is responsible for Challenge structure and gameplay decisions, not sponsors.

Sponsor participation does not guarantee prize availability or participation opportunities.

20. Private Submission Option

Users may have the option to mark certain submissions as private.

Private submissions:

  • Are used only for scoring and Challenge evaluation

  • Are not used for public promotion or marketing

  • Are not shared with sponsors unless required for Challenge verification

The 4UNT may still review private submissions for:

  • Moderation purposes

  • Rule enforcement

  • Safety concerns

  • Technical administration

Private submissions are not considered confidential or privileged communications and may be accessed internally as necessary to operate the Platform.

The 4UNT may disclose submissions if required by law or legal process.

The 4UNT will make reasonable efforts to respect private submission designations but does not guarantee absolute privacy.

21. Content Removal Requests

Users may request removal of their submitted content by contacting The 4UNT through designated support channels.

The 4UNT will make reasonable efforts to remove eligible content from active areas of the Platform.

However, we cannot guarantee removal from:

  • Past marketing materials

  • Archived materials

  • Previously shared media

  • Third-party platforms where content was shared

  • Historical records such as leaderboards

Content removal requests do not automatically revoke licenses already granted under these Terms.

Removal timelines may vary depending on technical and operational limitations.

The 4UNT reserves the right to retain content where necessary for:

  • Legal compliance

  • Fraud prevention

  • Dispute resolution

  • Platform integrity

22. Subscriptions

The 4UNT offers paid memberships that may include different tiers of access and features.

Examples may include:

  • Base membership

  • User+ membership

Subscription features and pricing may change over time.

By purchasing a subscription, you authorize recurring billing for the selected membership tier.

Subscriptions:

  • Bill automatically

  • Renew monthly unless canceled

  • Continue until canceled by the user

You are responsible for:

  • Maintaining valid payment information

  • Canceling before renewal if you do not wish to continue

  • Any charges incurred before cancellation takes effect

The 4UNT reserves the right to:

  • Modify pricing

  • Modify features

  • Introduce new membership tiers

  • Discontinue tiers

With reasonable notice where required.

Failure to maintain valid payment information may result in:

  • Suspension of membership benefits

  • Loss of access to paid features

23. Billing Terms

By subscribing to The 4UNT, you agree that:

  • Charges recur automatically based on your selected subscription

  • You authorize The 4UNT and its payment processors to charge your payment method

  • Pricing may change with reasonable notice

  • You are responsible for canceling your subscription before the next billing cycle if you do not wish to be charged

All payments are final once a billing period begins. No refunds or partial refunds are provided except where required by law.

Cancellation stops future billing but does not retroactively refund prior charges.

The 4UNT may suspend or terminate access to paid features for:

  • Failed payments

  • Chargebacks

  • Payment disputes

  • Billing abuse

Access to paid features may continue until the end of the current billing period unless otherwise stated.

Payment processing may be handled by third-party providers. The 4UNT does not store full payment details.

Applicable taxes or fees may apply depending on jurisdiction.

24. Cancellation

Users may cancel their subscription at any time through their account settings or designated cancellation method.

Cancellation takes effect at the end of the current billing period.

You will continue to have access to paid features until the billing period expires unless otherwise stated.

Cancellation:

  • Stops future billing

  • Does not refund current billing period charges

  • Does not provide partial refunds

  • Does not retroactively cancel charges already processed

After cancellation:

  • Paid features may be removed

  • Account access may revert to free-tier features (if available)

The 4UNT is not responsible for failure to cancel prior to renewal.

Users may resubscribe at any time.

25. Prizes

The 4UNT may offer prizes including but not limited to:

  • Merchandise

  • Sponsor prizes

  • Gift cards

  • Experiences

  • Promotional rewards

Prize availability may vary and is not guaranteed.

The 4UNT reserves the right to:

  • Substitute prizes

  • Modify prizes

  • Cancel prizes

  • Change prize eligibility requirements

  • Adjust prize distribution

Prizes have no cash value unless explicitly stated.

Users are responsible for any taxes, fees, or reporting obligations related to prizes.

Prize eligibility may be revoked in cases of:

  • Rule violations

  • Cheating

  • Misconduct

  • Account termination

The 4UNT is not responsible for:

  • Sponsor prize availability

  • Shipping delays

  • Third-party fulfillment issues

Prizes may be refused or forfeited if users cannot be contacted or fail to respond within a reasonable timeframe.

26. No Guarantee of Availability

The 4UNT is provided on an "as available" basis.

We do not guarantee:

  • Continuous service

  • Challenge availability

  • Platform uptime

  • Feature permanence

  • Error-free operation

  • Compatibility with all device

The Platform may experience interruptions due to:

  • Maintenance

  • Updates

  • Technical issues

  • Third-party service outages

  • Network failures

The 4UNT reserves the right to modify, suspend, or discontinue any part of the Platform at any time. 

We are not liable for interruptions, delays, or loss of access.

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

The 4UNT shall not be liable for failure or delay caused by events beyond reasonable control including natural disasters, government actions, internet outages, or third-party failures.

27. Release of Liability

To the maximum extent permitted by law, you agree to release, waive, and hold harmless The 4UNT and its owners, operators, affiliates, partners, sponsors, contractors, and representatives ("Related Parties") from any claims, damages, losses, liabilities, or expenses arising from or related to:

  • Participation in Challenges

  • Voluntary activities

  • Travel to or from Challenge locations

  • Interaction with public spaces or businesses

  • User submissions

  • Prize participation or acceptance

  • Platform use

  • Interactions with other users

This release includes claims related to:

  • Personal injury

  • Property damage

  • Accidents

  • Delays

  • Third-party actions

You agree that participation is voluntary and at your own risk.

This release applies to the maximum extent permitted by law, including claims arising from ordinary negligence.

28. Limitation of Liability

To the maximum extent permitted by law, The 4UNT and its owners, operators, affiliates, partners, sponsors, contractors, and representatives shall not be liable for:

  • Personal injuries

  • Property damage

  • Losses

  • Lost profits

  • Lost data

  • Indirect damages

  • Incidental damages

  • Consequential damages

  • Punitive damage

Arising from or related to:

  • Platform use

  • Participation in Challenges

  • Travel

  • User interactions

  • Prizes

  • Service interruptions

The Platform is provided "as is" and "as available" without warranties of any kind.

To the maximum extent permitted by law, total liability of The 4UNT for any claim shall not exceed the total amount of fees paid by the user in the twelve (12) months preceding the claim.

If no fees were paid, liability shall be limited to the minimum amount permitted by law.

29. Indemnification

You agree to defend, indemnify, and hold harmless The 4UNT and its owners, operators, affiliates, partners, sponsors, contractors, and representatives ("Related Parties") from and against any claims, damages, liabilities, losses, and expenses, including reasonable legal fees, arising from or related to:

  • Your conduct

  • Your participation in Challenges

  • Your submissions

  • Your violations of these Terms

  • Your violations of laws or regulations

  • Your interactions with other users or third parties

  • Your infringement of intellectual property or privacy rights

This includes claims brought by third parties arising from your actions.

You agree to cooperate with reasonable requests related to the defense of such claims.

30. Arbitration Agreement

To the maximum extent permitted by law, any disputes arising from or related to The 4UNT or these Terms shall be resolved through binding arbitration rather than in court, except where small claims court is permitted.

Before initiating arbitration, you agree to attempt to resolve disputes informally by contacting The 4UNT.

Arbitration shall:

  • Take place in California

  • Be conducted on an individual basis only

  • Not allow class actions or class arbitration

  • Be governed by applicable arbitration rules

You agree that:

  • You waive the right to a jury trial

  • You waive the right to participate in class actions

  • Claims must be brought individually

This arbitration agreement does not prevent either party from bringing eligible claims in small claims court.

If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain in effect.

31. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any legal actions not subject to arbitration shall be brought in the appropriate courts located in Santa Clara County, California.

You consent to the personal jurisdiction of such courts.

32. Privacy

Your use of The 4UNT is also governed by our Privacy Policy, which describes how we collect, use, and protect user information.

By using the Platform, you consent to the collection and use of information as described in the Privacy Policy.

This may include information such as:

  • Account information

  • Submissions

  • Location data (where applicable)

  • Usage data

  • Communications

Information may be used to:

  • Operate the Platform

  • Provide Challenge functionality

  • Improve services

  • Maintain safety

  • Enforce rules

33. Platform Changes

The 4UNT reserves the right to:

  • Update these Terms

  • Change features

  • Modify services

  • Add or remove functionality

  • Discontinue portions of the Platform

We may update these Terms from time to time. When material changes occur, we may provide notice through the Platform or by other reasonable means.

Updated Terms become effective upon posting unless otherwise stated.

Continued use of the Platform after updates constitutes acceptance of the revised Terms.

You are responsible for reviewing Terms periodically.

34. No Agency Relationship

Users participate in The 4UNT as independent participants only.

Nothing in these Terms creates any relationship of:

  • Employment

  • Agency

  • Partnership

  • Joint venture

  • Contractor relationship

  • Representation

Users are not authorized to:

  • Represent The 4UNT

  • Act on behalf of The 4UNT

  • Bind The 4UNT to any agreement

  • Speak for The 4UNT or its sponsors

Participation does not create any employment or business relationship with The 4UNT or its partners.

35. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

If any provision cannot be enforced as written, it shall be modified only to the extent necessary to make it enforceable while preserving its original intent.

36. Entire Agreement

These Terms, together with the Privacy Policy and any referenced rules or policies, constitute the entire agreement between you and The 4UNT regarding use of the Platform.

These Terms supersede any prior agreements, communications, or understandings, whether written or oral.
